Bail bonds for domestic violence charges have always been easy to write. The case usually entails a husband and wife in an argument and the neighbors overhearing and calling the police. When the police show up at the house, someone will go to jail. Ever since the O.J. Simpson trial, law enforcement’s hands have been tied. If they go to a house on a domestic violence charge, they have to arrest someone, regardless of the situation.

Bondsman love to write these bonds. Because the domestic argument is usually a mistake or a heat-of-the-moment situation, it is very low risk. Typically the spouse that isn’t arrested will post bail for the spouse in jail, and everything turns out fine. The defendant will have to make a court appearance or two and the case will be dropped, or they will be sent to anger management classes.

One night I got a call from someone wanting to post bail for his daughter. She and her husband were arrested in a domestic violence incident. The neighbors had reported them, as usual. The woman’s father was a long-time resident of the community, had a good job, and he explained it was just an argument that became loud. It was an easy bond to write, so I agreed.

I went down to the jail to post the bond, and as soon as the woman was released, she asked me to post bail for her husband. So I did.

The next day I learned that as soon as the woman and her husband arrived home that night, they started fighting again and the police were called. They were taken back into custody the same night. This time they were put on a “no bail” hold, which meant the judge wanted to see them prior to letting them out of custody.

Because I had done my job of posting bail for them the first time around, I was able to keep my fee, even though they were now back in jail. Because they refused to stop arguing with each other, they had wasted the money they paid me. This wasn’t the first or the last time a domestic violence case ended that way.
